German Court Rules Comparing Israel to Nazi Regime Is Not a Criminal Offence

A higher regional court in Germany has ruled that comparing Israel’s actions to those of Nazi Germany is not, by itself, a criminal offence, overturning the conviction of an Instagram user accused of illegally displaying Nazi symbols.

Conviction Overturned After Appeal

According to reports published this week by the leading legal database, beck-online, a woman was convicted by a lower court in the city of Ludwigshafen of the criminal offense of ‘using symbols of unconstitutional organizations’ when she made multiple posts on Instagram comparing Israel’s military activity in Palestine to the Nazi regime.

Initially sentenced to a €2400 fine, the decision was overturned after an appeal to the higher regional court of Zweibruchem. The court acquitted, citing the defendant’s right to freedom of speech and cautioned against interpreting the original criminal offense too broadly.

What the Case Was About

The posts in question were a series of comparisons between Israel and the Nazi Party. Including a table comparing the activities of the two regimes, an image combining the flag of Israel and the flag of the Nazi Party, and another depicting the Star of David enclosing a swastika alongside the hashtags #FreePalestine and #GazaUnderAttack.

German law generally prohibits the display and use of Nazi symbols, except in contexts such as education, art, journalism, or criticism of unconstitutional ideology. 

The final verdict detailed that the condition for criminal offense was not fulfilled because the user was ultimately condemning the Nazi-era ideology through the use of the symbols. A literal interpretation of using unconstitutional symbols and fining her would be undermining her freedom of speech.

Global Stance vs Local Sentiments

Coming amid Germany’s longstanding political and military support for Israel, the decision is particularly significant. Just recently, the Bundesrat, Germany’s upper house of parliament, backed proposed legislation criminalizing the denial of Israel’s right to exist, punishable by up to five years in prison.

Both nations have deep defence ties. Anadolu Agency reports: “Berlin authorized nearly €800 million in arms export licenses for Israel in the first five months of 2026.” Earlier this year, Germany was also one of only two EU member states to oppose suspending the EU-Israel Association Agreement, according to Al Jazeera and Courthouse News Agency. 

While Germany has remained one of Israel’s strongest supporters on the international stage, the ruling suggests that the debate is far more nuanced at home. As public scrutiny over the war in Gaza continues, German courts may increasingly find themselves navigating the line between the country’s historical responsibility, its support for Israel, and constitutional protections for freedom of expression.
