South Africa is slated to present its argument on Thursday, with Israel scheduled to present its defence on Friday.
In its formal submission, South Africa contends that Israel’s actions are purportedly aimed at precipitating the demise of a substantial segment of the Palestinian national, racial, and ethnic community.
The submission alleges that Israel’s activities encompass the killing of Palestinians in Gaza, causing them severe physical and psychological harm, and subjecting them to living conditions designed to bring about their physical obliteration.
The current situation involves a call for “provisional measures” by the International Court of Justice (ICJ) regarding the ongoing conflict between Israel and Gaza. The request, made by South Africa, urges the court to implement urgent measures, including the cessation of all Israeli military activities in Gaza
In response, Israeli President Isaac Herzog has dismissed the accusations as “atrocious and preposterous,”
He further asserted that Israel will present its case of self-defense under humanitarian law at the ICJ.
He asserted that the Israeli military is exerting maximum effort within the highly intricate conditions on the ground to prevent unintended repercussions and minimize civilian casualties
The International Court of Justice (ICJ), situated in The Hague, Netherlands, may expeditiously adjudicate South Africa’s petition for Israel to halt its military operations; however, a conclusive determination regarding the allegation of genocide by Israel could be protracted, potentially spanning several years.
While ICJ rulings theoretically possess legal binding authority for ICJ member states, including Israel and South Africa, practical enforcement mechanisms are absent.
In 2022, a court directive mandating Russia to promptly cease military operations in Ukraine was disregarded.
According to William Schabas, an esteemed professor of international law and the former chair of a UN committee investigating the 2014 conflict between Israel and Hamas, the threshold for the court to issue an injunction against Israel is relatively lenient
He conveyed to the BBC that South Africa must substantiate its case by demonstrating supportive elements, albeit without making a definitive determination regarding the actual occurrence of genocide.
South Africa has expressed strong criticism of Israel’s military operation in Gaza, with the ruling African National Congress demonstrating a longstanding commitment to the Palestinian cause.
The ANC draws parallels between the situation in Gaza and its historical struggle against apartheid—a policy of racial segregation and discrimination enforced by South Africa’s white-minority government until the democratic elections of 1994.
In the context of the conflict in Gaza, the Hamas-run health ministry reports a death toll exceeding 23,350 people since the initiation of the war following Hamas’s attacks on southern Israel on October 7. These attacks resulted in approximately 1,300 casualties, predominantly civilians, and the abduction of around 240 individuals.
