ICC issues arrest warrant for Netanyahu for ‘War crimes’ in Gaza

The International Criminal Court (ICC) has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and Hamas military commander Mohammed Deif, accusing them of war crimes and crimes against humanity during the Gaza conflict. This unprecedented move marks the first time an Israeli leader has been charged by the ICC, stirring significant global and regional reactions.

Charges and Allegations

The ICC judges have accused Netanyahu and Gallant of using starvation as a weapon of war, targeting civilians, and committing acts of persecution and inhumane treatment in Gaza from October 8, 2023, to May 20, 2024. They allege that Israeli-imposed blockades on Gaza deprived civilians of essential resources, including food, water, and medicine, leading to the deaths of many, including children.

Deif, reportedly killed in an Israeli airstrike in July 2024, was charged with mass killings, rape, and hostage-taking during the October 2023 Hamas-led attack that left 1,200 Israelis dead. The ICC prosecution stated it would continue gathering evidence regarding Deif’s reported death.

Reactions from Israel and Gaza

Israel rejected the ICC’s jurisdiction and denounced the warrants as “absurd and false.” Netanyahu’s office labeled the decision antisemitic, vowing to continue its military objectives. Foreign Minister Gideon Saar called the move a “dark moment” for the ICC.

In Gaza, residents expressed hope that the warrants signal a step toward justice. “Netanyahu and Gallant now are war criminals,” said Shaban Abed, a displaced engineer. Hamas welcomed the ICC’s actions, urging further accountability for Israeli leaders.

Global Implications

The warrants compel ICC member states to arrest the accused if they enter their territory, but enforcement remains uncertain. The United States, Israel’s key ally, is not a signatory to the ICC and criticized the decision as flawed. Meanwhile, European Union officials called for respecting the court’s ruling, though political divisions in the bloc may hinder coordinated action.

The ICC prosecutor, Karim Khan, emphasized the need for international cooperation in upholding the rule of law. “We count on states to respect and comply with these judicial orders,” he stated.

Impact on Netanyahu and Future Prospects

The ICC warrants are expected to limit Netanyahu’s international travel, as many member states will likely enforce arrest orders. Civil society groups in Israel, such as B’Tselem, view the court’s decision as an opportunity for Israelis to confront systemic oppression in Gaza.

Despite the ICC’s historic move, questions remain about its ability to enforce justice. The court relies on member states for arrests, a challenge highlighted by previous instances, such as South Africa’s failure to detain Sudanese President Omar al-Bashir.

Will the ICC Bring Accountability?

While the ICC’s actions represent a significant step in addressing alleged war crimes, enforcement challenges and political opposition cast doubt on its efficacy. Can international justice truly prevail in the face of geopolitical resistance?
